The problem of evil asks why an all-loving, all-powerful God would permit evil and suffering. Gianni Vattimo, a postmodern philosopher influenced by Nietzsche and Heidegger, returned to religion in the 1990s, but only addressed the concept of evil in a sustained fashion some twenty years later. Vattimo’s contribution to the problem of evil addresses the problem circuitously by analysing the concept of evil and by bringing in theological concept of grace, albeit rethinking these concepts in accordance with his own philosophical (...) style of ‘weak thought’. This article applies Vattimo’s understanding of evil and grace to the problem of evil, comparing his approach to Pareyson’s and analysing the extent to which Vattimo’s understanding of evil enables someone drawing upon his weak thought to provide an appropriate response to the problem of evil. In 428b.c.e.the city of Mytilene launched a revolt against the Athenians and invited the Spartans to send them assistance. The plans for the revolt were reported to the Athenians (3.2), who sent a force against the city (3.3). The Mytilenians asked for help from the Spartans (3.4.5–6), but the fleet they sent arrived too late to help the city (3.26.4). The revolt appears to have been the initiative of the city's wealthier citizens: Thucydides reports (3.27–8) that heavy armour was not (...) distributed to the people until Salaethus, the leader of the rebellion, realized that Spartan help would not arrive in time. Once the people received this armour, they refused to take orders from officials and held meetings, insisting that the government should distribute all available grain. If they did not, they threatened to negotiate on their own with the Athenians about surrender. The government was powerless to stop them and decided it was best to come to terms with the Athenians. It was agreed that the Athenians would have the power to act as they wished with the city and that the Mytilenians would have the right to send envoys to Athens to plead their case before the Assembly. When entering into a legal agreement, it is not unusual for one of the parties to ask the other to provide some security so as to ensure that the latter's obligations under the agreement will be fulfilled. There are two basic forms of security, personal and real. In personal security for a loan, the borrower arranges for a third party to come forward and to promise the lender that he will fulfil the borrower's obligations in the event that the borrower (...) does not make interest payments or repay the principal. In real security, the borrower pledges some of his property, either movable or immovable, as security to the creditor. If the borrower defaults, the creditor has the right to seize the property pledged as security, and, if he wishes, to sell it for cash in lieu of repayment. (shrink)

This essay examines the terms of the Judicial Oath sworn by the judges in the Athenian courts during the classical period. There is general agreement that the oath contained four basic clauses: to vote in accordance to the laws and decrees of the Athenian people, to vote about matters pertaining to the charge, to listen to both the accuser and defendant equally, and to vote or judge with one’s most fair judgment . Some scholars believe that the fourth clause gave (...) judges the right to vote according to their conscience and to ignore the law if they found it unjust. The first part of the essay shows that this clause gave judges the right to make decisions solely on the basis of their most just judgment only where the laws gave no clear guidance. It was a default clause invoked only twice in the extant orations; it was never used as justification to ignore the written laws. The second part addresses the view that the courts took political factors into account during trials. Although some trials involved leading politicians, the courts were bound by their oath to decide whether the defendant was guilty of the charge brought by the accuser. The only part of a trial where a defendant might mention his political achievements or his public largesse was at during the assessment of the penalty in a trial on a public charge. (shrink)

One of the most striking features of Athenian laws regulating commercial activities is the absence of any concept akin to the modern legal notion of the partnership or corporation. Despite the presence in Athenian society of numerous koinoniai, groups of individuals cooperating for some purpose, be it commercial or otherwise, Athenian law concerned itself solely with individual persons and did not recognize the separate legal existence of collective entities. And just as Athenian law did not recognize the legal existence of (...) partnerships or corporations, it also did not possess the notion of corporate liability. This meant that if someone entered into an agreement with a group of individuals and one of those individuals violated the terms of the agreement, the plaintiff proceeded only against the individual who acted contrary to the agreement, not against the group as a whole. If the plaintiff won his suit, he only had a right to receive compensation from the defendant's private property; he did not have a claim on all the funds held in common by the group. (shrink)

The style of weak thought associated with Gianni Vattimo involves positing that we are living after the death of God in an age of nihilism that is our ‘sole opportunity’. Nihilism, the lack of highest values, frees one from the ‘violence’ of metaphysics that silences one by reducing everything back to first principles. This article focuses on Vattimo’s return to Christianity, analysing in particular his use of terms found in the New Testament, kenosis and caritas. Vattimo sees the history of (...) the West as the secularisation of Christianity, reaching its culmination in the nihilism of late-modernity through the liberation of a plurality of interpretations from metaphysics. By analysing Vattimo’s notion of Being and use of Joachim of Fiore’s historical schema in relation to Paul’s distinction between the ‘spirit’ and the ‘letter’, it shall be argued that Vattimo’s understanding of Christianity does not involve the religion ‘superseding’ Judaism. However, this resolution comes at the cost of highlighting the lack of importance of Christianity for Vattimo if a broader understanding of Heidegger than Vattimo deploys is used to put Vattimo’s understanding of Being under scrutiny. According to the Aristotelian Constitution of the Athenians , the Assembly in Athens met four times every prytany. At each one of these meetings certain topics had to be discussed or voted on. For instance, a vote concerning the conduct of magistrates presently in office was to be taken at the κυρα κκλησα. At another meeting anyone who wished to could request a discussion of any matter, be it private or public. Nothing is said in this passage or anywhere else (...) in the Constitution of the Athenians about the possibility of holding additional meetings of the Assembly in times of emergency, but in a few passages in the Attic orators we find the term κκλησία σύγκλητος used. The scholia to these passages and some entries in the ancient lexica indicate that this term refers to an extra meeting of the Assembly which could be convened at short notice in order to deal with emergencies. On the basis of this information, scholars have in the past concluded that the Assembly normally met four times each prytany in the Classical period, but that extra meetings, called κκλησία σύγκλητο, could also be held if the need arose. Recently, however, M. H. Hansen, whose work on many aspects of the Assembly has greatly increased our understanding of Athenian democracy, has challenged this communis opinio. Hansen argues that the evidence found in the scholia and lexica is unreliable and should be disregarded. In his view, several passages in the speeches of Aeschines and Demosthenes and some fines in IG ii 212 indicate that the Assembly met a fixed number of times each prytany, no more, no less. (shrink)

How does talk work, and can we engage the public in a dialogue about the scientific study of talk? This article presents a history, critical evaluation and empirical illustration of the public science of talk. We chart the public ethos of conversation analysis that treats talk as an inherently public phenomenon and its transcribed recordings as public data. We examine the inherent contradictions that conversation analysis is simultaneously obscure yet highly cited; it studies an object that people understand intuitively, yet (...) routinely produces counter-intuitive findings about talk. We describe a novel methodology for engaging the public in a science exhibition event and show how our ‘conversational rollercoaster’ used live recording, transcription and public-led analysis to address the challenge of demonstrating how talk can become an informative object of scientific research. We conclude by encouraging researchers not only to engage in a public dialogue but also to find ways to actively engage people in taking a scientific approach to talk as a pervasive, structural feature of their everyday lives. Distinguishing “business” concerns from “ethical” values is not only an unfruitful and meaningless task, it is also an impossible endeavor. Nevertheless, fruitless attempts to separate facts from values produce detrimental second-order effects, both for theory and practice, and should therefore be abandoned. We highlight examples of exemplary research that integrate economic and moral considerations, and point the way to a business ethics discipline that breaks new ground by putting ideas and narratives about businesstogetherwith ideas and narratives about ethics.

One of the most ingenious arguments in all of Attic oratory is to be found in the speech Lysias wrote for Euphiletus to deliver at his trial for the murder of Eratosthenes . In his speech Euphiletus first describes to the court how his wife was seduced by Eratosthenes, then recounts how he discovered the affair, caught the adulterer in the act, and, despite an offer to pay compensation, slew him. Euphiletus defends his action by citing the law of the (...) Areopagus that whoever kills an adulterer caught in flagranti with his wife cannot be convicted of murder. Euphiletus further points out that the same exemption applies to the man who catches someone seducing his pallakē. If the lawgiver regarded the seduction of a pallakē as so serious that it merited the death penalty, Euphiletus argues, he must have regarded the seduction of a wife as even more reprehensible, deserving a penalty worse than death. In an increasingly data-driven age of medicine, do companies that offer genetic testing directly to patients represent an important part of personalising care, or a dangerous threat to privacy? Should we celebrate this new mechanism of patient involvement, or fear its implications?The Universities of Oxford and Cambridge addressed these issues in the 10th annual Medical Ethics Varsity Debate, through the motion: “This House Regrets the Rise of Direct-to-Consumer Genetic Testing”. Georg Wilhelm Hegel’s dialectic plays a crucial role in some of the thought of the most prominent Black thinkers. The role it plays has received little attention. In this dissertation, I begin to fill this lacuna in Africana Philosophy by examining the arguments of William Edward Burghardt Du Bois in “The Conservation of Races,” Frantz Fanon in Black Skin, White Masks and The Wretched of the Earth, and Cyril Lionel Robert James in The Black Jacobins: Toussaint L’Ouverture and the (...) San Domingo Revolution and Notes on Dialectics: Hegel, Marx, Lenin. I argue that forms of praxis are the result of their engagement with Hegel’s dialectic: reflexive practice, absolute praxis, and organic praxis respectively. I show that in each of these cases Hegel’s dialectical approach to history (dialectical thinking) was essential to their own attempts to understand the possibility of a positive transformation of the pervasively racist world they inhabited. In Athens during the late Classical and Hellenistic periods, it was customary for a man who was borrowing a large sum of money to pledge some property as security for the repayment of his loan. To show that this property was legally encumbered, a flat slab of stone, called a horos, was set up, and an inscription, indicating the nature of the lien on the property, was inscribed on the horos. These horoi served to warn third parties that the man (...) who pledged the property as security was not free to sell it or otherwise alienate it until the loan was repaid. The terminology which is used on these horoi to indicate that the property has been pledged as security varies. On a relatively small number of horoi, only seven, the property is described as ‘lying under ’ for a debt, the amount of which may or may not be specified. The texts found on a far greater number of horoi, some 128 in all, use a different type of expression. On these horoi, the property is said to have been ‘sold on condition of release’ . The terminology used on the horoi to describe this kind of lien presents a striking contrast with that employed by the Attic orators: in their speeches we find the verbs ποκεσθαι and ποτιθναι when it is a question of pledging security for a loan, but never ππρασθαι with the addition of the prepositional phrase π λσει. Now, over forty years later, she is “digging down through the layers, sifting through the running stream of memory” (p. 14). Her art of prospecting affords the reader (...) a linear impression of a journey that begins with “The Shimmering Maya,” a recountal of a family move in August 1944 from Colorado to South Texas. “Desert Silvery Blue” describes life in Alpine, Texas, while “Leaving for Good” narrates her experience of displacement as she departs Alpine in 1951 to attend Rice Institute, known then as “the atheist school” (p. 37). From Alpine to Houston, she experiences the greening of America and the shock of Gulf Coast humidity, “a sensation of being hit in the face and smothered” (p. 42). At Rice, she finishes her degrees, travels to France, her intellectual home, and returns, in “Cherry Time”—“Yes, Virginia, there is a Virginia” (p. 52)—to describe her life in full bloom during this relatively short but intense period, spent in and around the state of Virginia, before her permanent move to New Orleans. Ted Shotter's founding of the London Medical Group 50 years ago in 1963 had several far reaching implications for medical ethics, as other papers in this issue indicate. Most significant for the joint authors of this short paper was his founding of the quarterly Journal of Medical Ethics in 1975, with Alastair Campbell as its first editor-in-chief. In 1980 Raanan Gillon began his 20-year editorship . Gillon was succeeded in 2001 by Julian Savulescu, followed by John Harris and Soren (...) Holm in 2004, with Julian Savulescu starting his second and current term in 2011. In 2000 an additional special edition of the JME, Medical Humanities , was published, under the founding joint editorship of Martyn Evans and David Greaves. In 2003 Jane Macnaughton succeeded David Greaves as joint editor. Deborah Kirklin, under whose auspices MH became an independent journal, took over in 2008, and she was succeeded in 2013 by Sue Eckstein. This short paper offers reminiscences and reflections from the two journals’ various editors.From the start the JME was committed to clearly expressed reasoned discussion of ethical issues arising from or related to medical practice and research. In particular, both Edward Shotter and Alastair Campbell, each a cleric , were at pains to make clear that the JME was not a religious journal and that it had no sort of partisan axe to grind.Campbell's appointment as founding editor was something of a surprise, as the original intention had been to appoint a medical doctor, who could be expected to know medical practice from the inside. The 25th anniversary of R. Edward Freeman’s Strategic Management: A Stakeholder Approach provides an opportunity to consider where stakeholder theory has been, where it is going, and how it might influence the behavior of academics conducting stakeholder-oriented research. We propose that Freeman’s early work on the stakeholder concept supports the normative claim that a stakeholder’s contribution to value creation implies a right to stakeholder voice with regard to how a corporation makes decisions. Failure to account for stakeholder voice (especially (...) for non-shareholder stakeholders) works to the detriment of stakeholders. We further propose that business ethicists and stakeholder scholars have a role to play with regard to supporting the interests — including a right to voice — of non-shareholder stakeholders through advocacy, teaching, and scholarship. We use the example of industrial relations teaching and scholarship as a model for future business ethics teaching and scholarship. (shrink)

Previous assurance-theoretic treatments of testimony have not adequately explained how the transmission of warrant depends specifically on the speaker’s mode of address – making it natural to suspect that the interpersonal element is not epistemic but merely psychological or action-theoretic. I aim to fill that explanatory gap: to specify exactly how a testifier’s assurance can create genuine epistemic warrant. In doing so I explain (a) how the illocutionary norm governing the speech act proscribes not lies but a species of bullshit, (...) in an extension of Harry Frankfurt’s sense, (b) how that norm makes testimony fully second-personal, in Stephen Darwall’s sense, or bipolar, in Michael Thompson’s sense, and (c) how that species of second-personality or bipolarity is more fundamental than the practical species that Darwall and Thompson discuss. One attraction of this new Assurance View of testimony is that it allows us to reconceptualize the natures of normativity and responsibility more generally, viewing the assurance as implicating us in normative relations of recognition, and therefore of justice, that are not yet moralized with reactive attitudes. This paper examines one particular justification for the screening and termination of embryos/fetuses which possess genetic features known to cause disability. The particular case is that put forward in several places by John Harris. He argues that the obligation to prevent needless suffering justifies the prevention of the births of disabled neonates. The paper begins by rehearsing Harris's case. Then, drawing upon claims advanced in a recent paper in the Journal of Medical Ethics, it is subjected to critical (...) scrutiny, focusing on Harris's “suffering claim” .1 It is argued that the suffering claim must be false if understood as an empirical claim. And, even if understood as a conceptual truth, it mistakenly assimilates the concepts of harm and suffering. Finally, again focusing on Harris's recent work in this area, his characterisation of disability as a “harmed condition” is shown not to apply in the case of at least some moderate forms of intellectual disability. The revolt against logical positivism within the philosophy of science has now lasted long enough to produce something of a counter-revolution. As the more strident charges (positivistic analyses misrepresent the most fundamental features of the scientific enterprise and have contributed little or nothing to its clarification) and counter-charges (any attempt to induce a philosophy of science from studies in the history of science rests on a massive genetic fallacy) gradually subside, critical interest is focussing on the presuppositions that guide and (...) structure various interpretations of science. Here epistemological positions, often implicitly assumed, play a pivotal role. In the present article we shall try to make different positions and presuppositions explicit by examining some current developments in the philosophy of science. This examination will be focused on, though not limited to, three recent books by I. Schefller, S. Körner, and E. Harris. (shrink)

This article completes the study begun in I by a detailed consideration of errol harris's, "the foundations of metaphysics in science" and by an independent interpretation of the epistemological foundations of scientific theories. This is done in terms of two components labelled 'a physical language' and 'a mathematical language'. A physical language is conceived as a transformed extension of ordinary language which preserves its basic structural principles while modifying its descriptive metaphysics. The relation between such a physical language and (...) a mathematical system is explained by a correspondence between second order physical predicates and first order mathematical predicates. Originally published in 1995, The Antievolution Pamphlets of Harry Rimmer is the sixth volume in the series, Creationism in Twentieth Century America. The volume brings together original sources from the prominent evangelist and pastor Harry Rimmer. The consortium of pamphlets in this volume detail Rimmer's antievolutionist sentiments, a notion which characterized his early writings. The pamphlets detail Rimmer's rhetoric on evolution and science from the early part of the 20th century as he travelled across America to disseminate his writings. The (...) works in this volume address Rimmer's polemic on the danger posed by modern science and the consequential disassociation with religion. While Rimmer did not discount science itself, he argued for, what he termed, 'true science', claiming that modern science was based only in scientific opinion and not fact. As a self-proclaimed scientist, these writings take a unique view of the relationship between religion and science from this period through Rimmer's dual nature as both scientist and pastor. The work of Donaldson and Dunfee offers an example of how normative and descriptive approaches to business ethics can be integrated. We suggest that to be truly integrative, however, the theory should explore the processes by which such integration happens. We, therefore, sketch some preliminary thoughts that extend Integrative Social Contracts Theory by beginning to consider the process by which microsocial contracts are connected to hypernorms.
